1. Acceptance of these terms
These Terms and Conditions ("Terms") form a legal agreement between you and ZeroW SE Melbourne (ABN 42 688 830 926, operating from 28 Remount Wy, Cranbourne West VIC 3977). By becoming a member, entering one of our competitions, using our facilities, or using this website, you agree to be bound by these Terms together with our Privacy Policy and Code of Conduct.
If you do not agree to any part of these Terms, please do not use our services.
2. Memberships
We offer three weekly membership tiers (Standard, Gold, Platinum), with optional Weekly Nutrition Coaching add-ons. Pricing and inclusions for each tier are listed on our website at the time you sign up.
Membership signup and ongoing billing is processed by our membership provider, ClubFit. By signing up via the membership links on our website, you also agree to ClubFit's terms, which govern direct debits, billing, and account management.
You must be 18 or over to hold a personal membership. We do not currently offer memberships to under-18s outside of structured coaching arrangements.
3. Pricing & payment
All prices are in Australian Dollars (AUD) and include GST where applicable.
Recurring memberships are billed weekly via ClubFit using the payment method you nominate. It is your responsibility to keep your payment details current. Failed payments may result in suspension of access.
Competition entries are charged as a one-off via Stripe at the time of entry. We do not store your card details.
4. Cancellation, suspension & refunds
Memberships
You may cancel your weekly membership at any time by notifying us in writing (email is fine) and giving the notice period stated in your ClubFit membership agreement. Membership fees already paid for the current billing period are not refundable; you'll retain access until the end of the period you've paid for.
We may, in our sole discretion, agree to suspend (freeze) a membership for a defined period (for example, due to injury, travel, or extended illness). Suspensions must be requested in writing and are subject to any administrative fee notified at the time.
Competition entries
No refunds — comps Competition entries are non-refundable. By entering, you acknowledge and accept this. If the competition is cancelled or rescheduled by ZeroW SE Melbourne, refunds or transfers may be offered at our discretion.
Coaching & assessment sessions
Booked coaching or technique-assessment sessions cancelled with less than 24 hours' notice may be charged in full. Sessions cancelled with at least 24 hours' notice can usually be rescheduled within a reasonable period.
5. Use of the facility & 24/7 access
- Members have 24/7 access via the access app and credentials issued at signup. The facility is staffed 7am–7pm Monday to Friday.
- You agree not to share, lend, or duplicate your access credentials, and not to allow non-members to enter the facility.
- CCTV operates throughout the facility for safety and security. By entering, you consent to being recorded.
- You must follow our Code of Conduct at all times.
- We may close, modify, or restrict access to the facility for maintenance, events, or any other operational reason. Reasonable notice will be given where practical.
6. Coaching, programming & nutrition services
Where your membership tier includes coaching, programming, technique assessment, or nutrition services, those services are provided to you personally. They are not transferable.
Our coaches are qualified strength and nutrition coaches, but they are not medical professionals. Our advice does not replace professional medical, dietetic, or psychological care. If you have an injury, medical condition, or are pregnant, you should consult an appropriate health professional before acting on our recommendations.
7. Competition entries
To enter a competition you must complete the relevant entry form, accept the participant waiver, and pay the entry fee. By entering you confirm:
- You are aged 18 or over, or you are entering with the express consent of a parent or guardian who will be present at the event;
- The information you provide (including your APL membership ID for sanctioned events, weight class, equipment, and event selection) is accurate;
- You will comply with the rules of the relevant federation (e.g. Australian Powerlifting League) for sanctioned events;
- You will follow all instructions from event staff, judges, and ZeroW SE Melbourne personnel.
We reserve the right to decline, withdraw, or disqualify any entry at our sole discretion (for example, for breach of the federation rules, breach of our Code of Conduct, or providing false information).
8. Inherent risks & waiver
Strength training, powerlifting, and strongman/strongwoman activities are physically demanding and carry inherent risk of injury, including (without limitation) musculoskeletal strain, joint and ligament injury, fractures, dislocations, and in rare cases serious or permanent injury.
By using our facility, taking part in coaching sessions, or entering a competition, you acknowledge and voluntarily accept these risks. You confirm that you are physically able to participate, and that you have disclosed any relevant medical conditions to us.
To the maximum extent permitted by law, you release ZeroW SE Melbourne, its owners, staff, and contractors from claims for injury, loss, or damage arising from your participation, except where caused by our gross negligence or wilful misconduct.
9. Liability & consumer rights
Nothing in these Terms excludes, restricts, or modifies any rights or guarantees you have under the Australian Consumer Law (ACL) or any other law that cannot lawfully be excluded, restricted, or modified.
Subject to those rights, and to the maximum extent permitted by law:
- Our services are provided on an "as is" basis;
- We are not liable for any indirect, incidental, special, or consequential loss;
- Our total liability to you for any claim arising under or in connection with these Terms is limited to the total fees paid by you to us in the 12 months preceding the event giving rise to the claim.
10. Code of Conduct compliance
Use of our facility is conditional on compliance with our Code of Conduct. We may issue warnings, suspend, or terminate the membership or event registration of any person who breaches the Code, without refund.
11. Intellectual property
The ZeroW name, logo, and brand assets are the property of ZeroW and its licensors. Photographs, videos, written content, programming templates, and other materials produced by ZeroW SE Melbourne are protected by copyright. You may not copy, reproduce, distribute, or commercially use any of our materials without prior written consent.
Where you submit photos, videos, or testimonials to us (for example, to feature on social media), you grant us a non-exclusive, royalty-free licence to use that content in our marketing. You can ask us to stop using a specific submission at any time by contacting us.
12. Use of the website
You agree not to use this website to:
- Submit false, misleading, or fraudulent information through our forms;
- Interfere with the proper operation of the website (for example, by submitting malicious code, attempting to bypass authentication on the admin area, or running automated abuse);
- Infringe the rights of any other person.
We may take any technical, legal, or administrative steps necessary to protect our website, our staff, and our members.
13. Changes to these terms
We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when they were last revised. Material changes will be communicated through the website. Your continued use of our services after a change indicates your acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of the State of Victoria, Australia. Any dispute arising under or in connection with these Terms is subject to the exclusive jurisdiction of the courts of Victoria.
